FashionAI Terms of Use

These Terms of Use govern your access to and use of FashionAI, a mobile application developed by WildFruit Oy. By downloading, installing, or using FashionAI, you agree to be bound by these terms.

1. Acceptance of Terms

By using FashionAI, you confirm that you are at least 13 years old and capable of entering into a binding agreement. If you are under 18, you must have your parent or guardian's permission to use the app.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use FashionAI for your personal, non-commercial use. You may not:

• Modify, reverse engineer, or create derivative works of the app
• Use the app for any commercial purpose without our written consent
• Attempt to access or use the app's underlying AI models or algorithms
• Use the app to process photos you do not have rights to
• Violate any applicable laws or regulations while using the app

3. User Content

You retain all rights to the photos you upload to FashionAI. By uploading photos, you grant us a limited license to process them for the purpose of providing you with outfit ratings and feedback. We do not claim ownership of your photos.

You represent and warrant that you have the right to upload any photos you submit and that they do not violate any third-party rights or applicable laws.

4. AI-Generated Content

FashionAI provides outfit ratings and feedback generated by artificial intelligence. These ratings are subjective and based on algorithmic analysis. They should not be considered professional fashion advice or absolute judgments.

While we strive for accuracy, AI-generated content may occasionally be incorrect, incomplete, or not suitable for your specific needs. You use the ratings and feedback at your own discretion. FashionAI does not provide professional styling, psychological, or self-image advice.

5. Prohibited Content

You agree not to upload photos that contain:

• Nudity or sexually explicit content
• Violent, graphic, or disturbing imagery
• Content that violates any person's privacy rights
• Illegal content or content promoting illegal activities
• Hate speech or discriminatory content

We reserve the right to refuse service or terminate accounts that violate this policy.

6. Subscription and Payment

FashionAI may offer free and paid subscription tiers. Subscriptions are billed through your Apple App Store account. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. We reserve the right to change subscription pricing. Any changes will apply to future billing periods and will be communicated through the App Store.

Refunds are handled according to Apple's App Store refund policies. We do not provide refunds for partial subscription periods.

7. Disclaimer of Warranties

FashionAI is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the app will be error-free, uninterrupted, or meet your expectations. We do not warrant the accuracy, reliability, or completeness of AI-generated ratings. Your use of the app and reliance on any AI-generated feedback is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, WildFruit Oy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FashionAI, including but not limited to loss of data, lost profits, or damages resulting from reliance on AI-generated content. In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim.

9. Changes to the App

We may modify, suspend, or discontinue FashionAI or any features at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the app.

10. Termination

We reserve the right to terminate or suspend your access to FashionAI at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties. You may stop using the app at any time and delete it from your device. Data handling is described in our Privacy Policy.

11. Indemnification

You agree to indemnify and hold harmless WildFruit Oy from any claims, damages, or expenses arising from your misuse of the app or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising from or related to these Terms or the use of our services shall be resolved in the courts of Finland.

13. Changes to Terms

We may update these Terms of Use from time to time. Continued use of FashionAI after changes constitutes acceptance of the updated terms.
